“The Aged Care Industry Labour Agreement was introduced to address the significant skill shortages within the Australian aged care sector. It provides a streamlined pathway for aged care providers to sponsor overseas workers for certain occupations where there’s a demonstrated need that cannot be met by the local Australian workforce.”
“Under this agreement, employers can sponsor workers in roles such as Nursing Support Workers, Personal Care Assistants, and Aged or Disabled Carers. One of the key benefits of this Labour Agreement is that it offers several concessions that aren’t typically available under the standard skilled visa programs.”
“For example, it provides a pathway to permanent residency for sponsored workers, which is a significant incentive for attracting and retaining skilled staff in this critical sector. There are also concessions on the English language proficiency requirements and the salary threshold, making it more accessible for both employers and potential employees.”
“To utilize the Aged Care Industry Labour Agreement, employers must first enter into a Memorandum of Understanding (MOU) with the relevant industry union. This is a unique requirement of this specific agreement and ensures that the rights and conditions of both overseas and local workers are protected.”
“Once the MOU is in place, the employer can then apply to the Department of Home Affairs to enter into the Labor Agreement itself. This involves demonstrating that they have a genuine need for the overseas workers and that they have made efforts to recruit locally first.”
“Once the Labour Agreement is approved, employers can then sponsor workers under the Subclass 482 (Temporary Skill Shortage) visa. After working in the sector for a specified period-usually two years-these workers may then be eligible to apply for permanent residency through the Employer Nomination Scheme (Subclass 186).”
